Once again, we address you as an ad hoc body in charge of implementing the civilian aspects of the Dayton Peace Agreement, regarding the systematic cover-up of the brutal murder of David Dragicevic by the Ministry of Internal Affairs of the Republic of Srpska and the Banja Luka District Public Prosecutor’s Office.

The OHR has been repeatedly informed of the criminal moves of the two institutions in conducting an investigation into the Dragicevic case.

As a body that guarantees the unconditional implementation of the constitution and the law, you have the obligation to react without further delay to the illegal actions of the District Public Prosecutor’s Office of Banja Luka, and the acting prosecutor Dalibor Vreco. The patience of the parents of the late David and the group Justice for David, represented by the Association of Citizens “Path of Justice” Banja Luka and the Association “Justice for David” and all the children of Bosnia and Herzegovina from Vienna is running out. Your constant concern is incomprehensible without concrete moves for which you have a mandate, authority, but also an obligation to implement them.

Acting prosecutor Dalibor Vreco is known to the public for the “Naerac” affair when he planted a fake criminal who was tried and convicted for a crime in agreement with the prosecution instead of the real perpetrator of that crime. The affair that would place such a prosecutor on the dock in any state governed by the rule of law did not prevent Prosecutor Vreco from continuing to perform the prosecutorial function.

Prosecutor Vreco, contrary to the legal regulations on the manner of assigning certain cases, is in charge of the Dragicevic case, which is another serious violation of the prescribed procedures by the then Chief Prosecutor Zelimir Lepir and the Prosecutor of Vreco.

Three years after the case was taken over, the acting prosecutor did everything possible to prolong the case and to conduct the investigation in the wrong direction. On 04/21/2021 after a full three years, the trial of members of the Ministry of Internal Affairs of the Republic of Srpska (Bosnjak-Marjanac) begins for the deliberate destruction of the crown evidence on the circumstances of the murder, with the intention of preventing or complicating the investigation.

We would like to remind you that the suspects Bosnjak and Marjanac were direct associates of the Prosecutor of the Bag in the investigation of the murder of David Dragicevic. Prosecutor Vreco is also the acting prosecutor in this lawsuit. The prosecutor cannot conduct proceedings against his associates because the responsibility lies with the prosecutor. It is indisputable that Bosnjak and Marjanac committed a serious criminal offense, but in that procedure the prosecutor cannot be Vreco because they are his associates, so the prosecutor Vreco himself is an interested party responsible for the actions of the associates.

The defendant technicians directly accused their superior (Inspector Sinisa Kojdic) of ordering them to throw or destroy evidence. However, the acting prosecutor Vreco makes a prosecutor’s decision not to conduct an investigation against his associate Inspector Kojdic. And for the same act, under public pressure, he filed an indictment against two lower-ranking technicians. Such an illogical and shameful move by the prosecutor clearly proves the actions that lead in the direction of covering up the murder.

As the High Judicial Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH) and the Banja Luka District Public Prosecutor’s Office did not sanction the acting prosecutor or respond positively to requests that the case be assigned to another prosecutor, any possibility of David Dragicevic’s murder and other related cases being exhausted. legal framework.

Your duty as an international institution that guarantees the implementation of positive legal regulations according to its mandate is to react urgently and prevent further abuse of the high prosecutorial function and thus prevent further cover-up of the murder by the prosecution. Otherwise, you will bear part of the responsibility for any possible damage caused by the public’s great unrest.
