LETTER SENT TO THE OHR AND THE PROSECUTOR’S OFFICE OF BIH “We ask the OHR and the Prosecutor’s Office of BiH to find an adequate solution to stop this trial in Banja Luka due to the possible negative consequences of this trial on the investigation into the murder of David Dragicevic”

We are addressing you on behalf of the citizens’ association “Put Pravde” Banja Luka, Bosnia and Herzegovina, founded by human rights activists “Justice for David” and we inform you that on December 2, 2021 in the Basic Court in Banja Luka, the main trial will continue in the proceedings against Mikica Marijanac and Zoran Bošnjak (crime technicians charged with destruction of crown evidence – underwear, case no. 71 0 K 291612 19 K, acting judge Radmila Medakovic).

The trial before the Basic Court in Banja Luka should be STOPPED.

It is a staged trial that contributes to covering up the murder of David Dragicevic, and thus this staged trial directly affects the investigation into the case of the organized murder of David Dragicevic, which was taken over by the Prosecutor’s Office of BiH in April 2021. This is the most important material evidence, on the basis of which it was possible to establish exactly how David Dragicevic was killed. Therefore, the evidence was removed with the intention of not finding out the truth about the suffering of David Dragicevic, and it was removed by police officers in cooperation with the District Public Prosecutor’s Office in Banja Luka (hereinafter OJTBL).

The indictment in the case against the crime technician is represented by the prosecutor Dalibor Vreco, who was also the acting prosecutor in the case of the murder of David Dragičević, and the said case was under the jurisdiction of the OJTBL for three years. The above mentioned prosecutor obstructed the investigation for three years in order to cover up the case. We believe that the prosecutor Dalibor Vrećo, by being the acting prosecutor in the case of the murder of David Dragičević, cannot represent the indictment related to the crime technician because he is in a conflict of interest. By accepting the appeal of Davor Dragicevic (father of the murdered David Dragicevic), the Constitutional Court of BiH confirmed that the OJTBL did not conduct an adequate investigation. We emphasize that the adoption of the said appeal also confirmed the violation of the basic and most important human right, the RIGHT TO LIFE, which is guaranteed to us by the Constitution, as well as by international human rights treaties where BiH is a signatory state.

At previous hearings, the defense of the defendants also requested the disqualification of the prosecutor, but that proposal was not adopted.

Requests for the disqualification of the said dishonorable prosecutor were submitted several times in the case of the murder of David Dragicevic, by the father of the murdered young man, Davor Dragicevic, together with the lawyer Ifet Feraget, precisely because he led the investigation in the wrong direction from the very beginning. to the extent of abusing his prosecutorial position.

We emphasize another important fact for us, and that is the way in which prosecutor Dalibor Vreco was assigned the case of David Dragicevic’s murder without using the CMS program in which the then chief prosecutor Zelimir Lepir assigned the case to the said prosecutor at his own discretion.

Numerous reports were also filed with the HJPC, the Office of the Disciplinary Prosecutor, against the then Chief Prosecutor Zelimir Lepir, and the acting Prosecutor Dalibor Vreco, for all the above circumstances. Recently, there is an open case in the HJPC against the acting prosecutor Dalibor Vreco, but no concrete actions have been initiated yet.

Note: Resolving the murder of David Dragicevic and Dzenan Memic will not require any judicial reform, because resolving these two cases, which are of public interest, will automatically clean the judicial institutions of dishonest individuals, prosecuting all those who have been managing the judiciary for years. system for personal interests, and use institutions to cover up their own crime and corruption.

Due to all the above, we ask the OHR and the Prosecutor’s Office of BiH to find an adequate solution to stop this trial in Banja Luka due to the possible negative consequences of this trial on the investigation into the murder of David Dragicevic.
