We are addressing you on behalf of the citizens’ association “The Path of Justice” Banja Luka, Bosnia and Herzegovina, founded by human rights activists “Justice for David” and the humanitarian organization “Justice for David and all children of Bosnia and Herzegovina”, Vienna, Austria, founded by parents of the murdered David Dragicevic, and we file a complaint regarding the work of the District Public Prosecutor’s Office in Banja Luka, specifically against the work of prosecutor Dalibor Vreco for failing to conduct an adequate investigation to prevent evidence and concealment of those responsible in the case of organized murder of student David Dragicevic (21) from Banja Luka.
Prosecutor Dalibor Vreco, contrary to the legal regulations on the manner of assigning certain cases, is in charge of the Dragicevic case, which is another serious violation of the prescribed procedures by the then Chief Prosecutor Zelimir Lepir and Prosecutor Vreco.
For three years, the acting prosecutor did his best to lead the investigation in the wrong direction.
On 21.04.2021. The trial of members of the Ministry of Internal Affairs of the Republika Srpska (Bosnjak-Marjanac) for intentional destruction of the crown evidence on the circumstances of the murder begins, with the intention of preventing or complicating the investigation.
We note that the suspects Bosnjak and Marjanac were direct associates of Prosecutor Vreco in the investigation of the murder of David Dragicevic. Dalibor Vreco is also the acting prosecutor in this lawsuit. The prosecutor cannot conduct proceedings against his associates because the responsibility lies precisely with the prosecutor. It is indisputable that Bosnjak and Marjanac committed a serious criminal offense, but in that procedure the prosecutor cannot be Vreco because they are his associates, and the prosecutor Vreco himself is an interested party responsible for the actions of the associates. The defendant technicians directly accused their superior (Inspector Sinisa Kojdic) of ordering them to throw or destroy evidence. However, the acting prosecutor Vreco makes a prosecutor’s decision not to conduct an investigation against his associate Inspector Kojdic. And for the same act, under public pressure, he filed an indictment against two lower-ranking technicians. Such an illogical and shameful move by the prosecutor clearly proves the actions that lead in the direction of covering up the murder.
It is important to point out that the Office of the Disciplinary Prosecutor of the HJPC has initiated several disciplinary proceedings against Prosecutor Dalibor Vreco, and the acting prosecutor has been known to the public as a prosecutor who abuses his powers and position, in cooperation with the criminal circles.
As the High Judicial Prosecutorial Council of Bosnia and Herzegovina (HJPC BiH) and the Banja Luka District Public Prosecutor’s Office did not sanction the acting prosecutor or respond positively to requests that the case be assigned to another prosecutor, any possibility of David Dragicevic’s murder and other related cases being exhausted. legal framework.
Your duty as an international institution that guarantees the implementation of positive legal regulations according to its mandate is to react urgently and prevent further abuse of the high prosecutorial function and thus prevent further cover-up of the murder by the prosecution.
Note: On April 14th, 2021, the Prosecutor’s Office of Bosnia and Herzegovina, after reviewing the submitted files from the District Public Prosecutor’s Office Banja Luka and the Republic Public Prosecutor’s Office of Republic of Srpska – Special Department for Combating Corruption, Organized and Serious Forms of Economic Crime, decided to take over the case and work on the same in the Prosecutor’s Office of Bosnia and Herzegovina.
