organizes a series of public debates:

OPEN ABOUT THE POLICE, PROSECUTOR’S OFFICE, JUSTICE AND POLITICS!

Citizens’ Association “The Path of Justice” Banja Luka, founded by human rights activists “Justice for David” in cooperation with the association “Justice for David and all children of Bosnia and Herzegovina” Vienna, Austria with the support of the Friedrich Ebert Foundation (FES) – For Social democracy, organizes a series of Zoom public debates on the topic: OPEN ABOUT THE POLICE, PROSECUTOR’S OFFICE, JUDICIARY AND POLITICS! 

Leading representatives of the institutions of the system covered by the topic of debate are invited to each Zoom session. In addition to them, the invitation was sent to all those interested in public and political life.

The primary goal of this event is to insist on the criminal responsibility of all those who, by doing, but also by not doing, led to the obstruction of the investigation in the case of the murder of David Dragičević. The secondary goal of this event is a retrospective of the work of the Police, the Prosecutor’s Office and the Judiciary, and the role of Politics in the general view and the ways in which citizens reacted to the activities of system institutions in the specific case of David Dragičević’s murder.

The Ministry of the Interior, as the primary bearer of police activities, has recently been in the public spotlight due to inadequate work, organized crime and corruption that is present in the work of this institution on a daily basis. If we analyze the work of the police from the angle of the organized murder of David Dragičević, it is clear how much this institution reacted inadequately from the very beginning. During the search for the missing David, the police did not take all legal steps and did not organize an adequate search for the missing young man. After finding the body of the murdered David, the police continued their activities in the direction of violating fundamental rights, while as an institution they were in charge of protecting those same rights. By this we primarily mean the organization of a criminal press conference and the numerous lies told by which this institution tried to hide objective facts and protect its own crime. From the angle of the appearance of the first, civil, non-political, long-lasting protests “Justice for David”, we can clearly see how much the police directed their activities against the citizens, in the direction of violating basic human rights. The biggest witnesses are the events from December the 25th to 31st 2018, when we had police violence against the citizens of Banja Luka.

The topic of the first Zoom session is the Public Debate: OPEN ABOUT THE POLICE!

During this Zoom session, we will have the opportunity to listen to a short presentation on the work of the police in Banja Luka, their activities and treatment of citizens from the angle of the brutal murder of a young Banja Luka student in the city center. We ask an open question, what are the mechanisms for protecting citizens from inadequate police work? What are the mechanisms of civil society action against inadequate police work is one of the topics of public debate that will follow after a short presentation.

The topic of the second Zoom session is the Public Debate: OPEN ABOUT THE PROSECUTOR’S OFFICE!

The activities of the District Public Prosecutor’s Office in Banja Luka have recently been the focus of great criticism, major scandals, nepotism and corruption. The problem refers to the currently valid law on the work of the Prosecutor’s Office of the Republic of Srpska. Namely, according to the legal provisions, the Law on Public Prosecutor’s Offices of the Republic of Srpska (Official Gazette of the Republic of Srpska No. 69/2016) has all the powers of a prosecutor in a criminal investigation. According to this law, the injured party is not able to participate in the criminal proceedings, the whole process is up to the prosecutor. If the plaintiff does not act in accordance with the law and moral norms, the whole process is disrupted. After a short presentation on the actions of the District Public Prosecutor’s Office in Banja Luka in the specific case of the murder of David Dragičević, there will be a discussion on the problematic nature of the law on the work of the Prosecutor’s Office and mechanisms of civil society against inadequate work of the Prosecutor’s Office.

The topic of the third Zoom session is the Public Debate: OPEN ABOUT JUSTICE!

The establishment of an independent regulator in the field of justice was one of the most important steps in the reform of the judiciary created by the international community (OHR) following a comprehensive analysis of the functioning of the judicial system. The process began with the imposition of a law on three high judicial and prosecutorial councils, which functioned as a single body and in whose work international members also participated. The main goal was to eliminate the powerful influence of politics on the selection of judicial office holders and to establish an independent judiciary. The next step was the signing of an agreement on the transfer of jurisdiction in the field of justice from the entities to the state and the establishment of the High Judicial and Prosecutorial Council. How functional were the described steps? How many procedures have been followed? How many users of this institution have exercised their rights in general will be just some of the questions at this Zoom Session. The open question is the corrective impact of the “Dragičević” and “Memić” cases on the work of judicial institutions?

The topic of the fourth Zoom session is the Public Debate: OPEN ABOUT POLITICS!

After the murder of David Dragičević, the first, civil, long-lasting protests of Justice for David begin. The elections were the only turning point in this process, that is, the possibility that these events would affect the election results. They also tried to use the events related to the protest rallies of Justice for David from the opposition, whose campaign was almost based on this case. What is the role of politics and political turmoil in the specific “Dragičević”  case and in what way did politics influence specific events related to the murder and protest Justice for David?
