94.4% of respondents believe that there is a high level of corruption in the work of the Prosecutor’s Office

As part of the Anti-Corruption Campaign and raising public awareness about the work of the Prosecutor’s Office in the Republic of Srpska, the citizens’ association “The Path of Justice” Banja Luka conducted an online Survey on the work of the Prosecutor’s Office.

According to the current model of prosecutorial investigation, the prosecutor has enormous power over which there is no mechanism for either internal or external control (Law on Public Prosecutor’s Offices of the Republika Srpska (Official Gazette of the Republika Srpska No. 69/2016)). The prosecutor is free to decide whether to initiate an investigation, against whom he will open an investigation, when and against whom he will suspend the investigation, when he will accuse, when he will drop the accusation and whether he will file an appeal and whether he will withdraw the appeal. Add to that complete freedom in planning the investigation and completely free decision as to which evidence to present, and it is possible to conclude the extent of the prosecutor’s uncontrolled power. In the hands of an unscrupulous prosecutor, any investigation can be obstructed and deliberately ruined without any responsibility. Also, any accusation can be planned to end with an acquittal that covers abuses of prosecutorial powers.

Out of a total of 142 respondents, 94.4% believe that there is a high level of corruption in the work of the Prosecutor’s Office, while 5.6% of respondents partially agree with this item. In the coming period, as part of the Anti-Corruption Campaign and raising public awareness about the work of the Prosecutor’s Office in Republika Srpska, Justice for David will conduct public opinion polls and citizens’ attitudes on trust in the work of the Prosecutor’s Office.
